Giveaway Terms and Conditions

  1. Eligibility: This sweepstakes, giveaway, promotion (the “Giveaway”) is limited to eligible participants. To be eligible to participate in the Giveaway, an individual must be located within the United States of America, Washington, D.C., or a territory of the United States of America, and at least thirteen (13) years of age (“Entrant,” as a collective group “Entrants”).  Employees, officers, directors, and shareholders of Dashing Diva, Inc., dba Dashing Diva (“Dashing Diva”) and their respective parent, subsidiary, limited liability, and affiliated companies, and individuals providing services to Dashing Diva or any of its affiliated companies through an outsourcer or temporary employment agency as well as the immediate family (spouse, parents, siblings, and children) and members of the same household of such employees, officers, directors, and individuals are not eligible. Void where prohibited or restricted by law or regulatory agency. Participation constitutes Entrant’s full and unconditional agreement to the Giveaway Terms and Conditions (the “Official Rules”) and Dashing Diva’s decisions, which are final and legally binding in all matters related to the Giveaway. Winning the prize is contingent upon fulfilling all requirements set forth in these Official Rules.

 

  1. Giveaway Period: The Giveaway will commence on Monday, January 20, 2025 at 12:00 AM (midnight) Eastern Standard Time and conclude on Sunday, February 2, 2025 at 11:59 PM Eastern Standard Time (the “Giveaway Period”). Dashing Diva’s computer server will be the official timekeeper for all matters related to this Giveaway.

 

  1. To Enter: Entrant must be either 1) a new subscriber to Dashing Diva’s email and SMS text marketing lists during the Giveaway Period or 2) a previous subscriber to Dashing Diva’s email marketing list but joins Dashing Diva’s SMS text marketing list during the Giveaway Period (“Entry,” or in the plural “Entries”). No purchase necessary to enter, however internet access, may be required. Entrants must have a valid email address and telephone number, which can receive text messages. Dashing Diva must receive all Entries by 11:59 PM Eastern Standard Time on Sunday, February 2, 2025. All Entries received after the Giveaway Period are automatically disqualified.

 

  1. Eligibility: The Giveaway is open to individuals who are located within the United States of America, Washington, D.C., or a territory of the United States of America. All Entrants must be at least thirteen (13) years of age to enter. Entrants must be an active subscriber to Dashing Diva’s email and SMS text message marketing list at the conclusion of the Giveaway Period.

 

  1. Limit: One (1) Entry per Entrant regardless of the method of entry over the Giveaway Period. Entries become the property of Dashing Diva, upon Entry into the Giveaway.

 

  1. Disqualified Entries: Entries made by anyone other than a natural person, including but not limited to, commercial sweepstakes subscription notification and/or entering services, will be declared invalid and disqualified for this Giveaway. Tampering with the entry process or the operation of the Giveaway is prohibited, and any entries deemed by Dashing Diva, in its sole discretion, to have been submitted in this manner will be void. Entries generated by a script, macro, or other automated means will be disqualified. Entries that are incomplete, garbled, corrupted, or unintelligible for any reason, including, but not limited to, computer or network malfunction or congestion, are void and will not be accepted.

 

  1. Entrant Identity: In case of a dispute over the identity of an Entrant, the Authorized Account Holder of the email address used to enter will be deemed to be the Entrant. “Authorized Account Holder” is defined as the person who is assigned to an email address by an Internet Access Provider, online service provider or other organization that is responsible for assigning email addresses for the domain associated with the submitted email address.  

 

  1. The Prize: The Prize Winners will each receive one (1) gel products kit and accessories in a gift box (the “Prize”). Each Prize has a Retail Value of eighty dollars ($80.00). In total there are fourteen (14) Prizes, and the Prizes have a collective Retail Value of one-thousand-one-hundred-twenty dollars ($1,120.00). Dashing Diva reserves the right, in its sole discretion, to replace any or all Prizes with an alternative prize of equal or greater value if circumstances beyond Dashing Diva’s control make it necessary to do so. There is no cash alternative for any Prize. All appliable fees, incidental charges, and state and federal taxes associated with winning a Prize is the sole responsibility of the Prize Winner (as herein defined). Delivery of the Prize(s) may be delayed due to circumstances out of the control of Dashing Diva.

 

  1. Drawing: Winning Entries will be selected by a random drawing conducted on Monday, February 3, 2025 (the “Drawing”). There will be one (1) Drawing held for each calendar day of the Giveaway Period. During each Drawing, a winner will be randomly selected from all eligible Entries received during the applicable calendar day of the Giveaway Period (the “Prize Winner” or “Prize Winners”). There will be a total of fourteen (14) Prize Winners. Conduct of the Giveaway and the drawing are under the supervision of Dashing Diva. If a Prize Winner is found to be ineligible, or if he or she has not complied with these Official Rules, or declines the Prize for any reason prior to award, that Prize Winner will be disqualified and an alternate Prize Winner may be selected. An Entrant is not a winner of any Prize, even if the Giveaway should so indicate, unless and until Entrant’s eligibility and the potential winning Entry has been verified and Entrant has been notified that verification is complete.

 

  1. Odds of Winning: Each Entrant has a one (1) in approximately one thousand (1,000) chance of being selected as a Prize Winner. There are fourteen (14) Prizes to be awarded out of an anticipated distribution of twenty thousand (20,000) online Giveaway notices.

 

  1. Notification of Prize Winners: The Prize Winners will be notified within fifteen (15) days of the Drawing at the email address provided when the Entrants submitted their Entries (the “Prize Notification”). Dashing Diva shall not be liable for any potential Prize Notification that is lost, intercepted, or not received by any potential Prize Winners for any reason. If, despite reasonable efforts, a Prize Winner does not respond within two (2) business days of the first notification attempt, or if the Prize Notification is returned as unclaimed or undeliverable, such Prize Winner will forfeit his or her Prize and an alternate winner may be selected.

 

12. Dashing Diva General Terms: By registering to enter this Giveaway, Entrants affirm that Entrants have read and accepted these Official Rules. Dashing Diva reserves the right to cancel, suspend and/or modify this Giveaway, or any part of it, at any time, if any fraud, technical failure, or any other factor beyond Dashing Diva's reasonable control impairs the integrity or proper functioning of this Giveaway, as determined by Dashing Diva. Dashing Diva reserves the right, in its sole discretion, to disqualify any individual or Entrant it finds to be tampering with the entry process or the operation of this Giveaway or to be acting in violation of these Official Rules. Dashing Diva reserves the right to disqualify any Entrant who acts in a manner contrary to the spirit or intention of the Giveaway or otherwise submits content that is obscene, offensive, derogatory, illegal or otherwise inappropriate, in the sole discretion of Dashing Diva. Any attempt by any person to deliberately undermine the legitimate operation of this Giveaway may be in violation of criminal law, and should an attempt be made, Dashing Diva reserves the right to seek damages from any such person to the fullest extent permitted by law.  Dashing Diva's failure to enforce any term of these Official Rules shall not constitute a waiver of that provision.

 

13. Indemnification: By entering this Giveaway and/or accepting any Prize, an Entrant releases, discharges, and agrees to indemnify and hold harmless Dashing Diva, and its parent, subsidiary, limited liability, and affiliated companies, and advertising and Giveaway agencies; and the shareholders, officers, directors, employees, members, agents, and assigns of the aforementioned entities, from liability of any kind or nature for any loss, claims, damages, or injuries of any kind resulting in whole or in part, directly or indirectly from Entrant’s participation in this Giveaway or from the acceptance and use/misuse of a Prize.

 

14. Liability Releases:

 

a.     Dashing Diva is not responsible for:

 

1.     Any incorrect or inaccurate information in connection with this Giveaway, whether caused by Entrants, printing errors or by any of the equipment or programming associated with or utilized in this Giveaway;

2.     Any Entries not received in a timely manner or Entries submitted after the Giveaway Period has ended;

3.     Technical failures of any kind, including, but not limited to, malfunctions, interruptions, or disconnections in phone lines, networks, hardware, and/or software failures;

4.     Unauthorized human intervention in any part of the entry process or this Giveaway;

5.     Technical or human error which may occur in the administration of this Giveaway or the processing of Entries;

6.     Late, lost, undeliverable, damaged, or stolen mail; or

7.     Any injury or damage to persons or property which may be caused, directly or indirectly, in whole or in part, from Entrant’s participation in this Giveaway or receipt or use or misuse of any Prize.

 

b.     If for any reason an Entry is confirmed to have been erroneously deleted, lost, or otherwise destroyed or corrupted, Entrant’s sole and exclusive remedy is another Entry in this Giveaway, provided that the Giveaway Period has not ended.  

 

c.     If this Giveaway is canceled, suspended, or modified, Dashing Diva, in its sole discretion, may elect to hold a random drawing from among all eligible Entries received up to the date of discontinuance for any or all Prizes offered herein. No more than the stated number of Prizes will be awarded.

 

d.     In the event that production, technical, seeding, programming, or any other reason cause more than the stated number of Prizes as set forth in these Official Rules to be available and/or claimed, Dashing Diva reserves the right to award only the stated number of Prizes via the Drawing. 

 

e.     If for any reason, any aspect of this Giveaway is not capable of running as planned, Dashing Diva may in its sole discretion cancel, terminate, modify, or suspend the promotion, or invalidate any affected Entries (this includes, without limitation, by reason of infection by computer virus, network failure, bugs, tampering, unauthorized intervention, fraud, technical failures, or any cause beyond the control of Dashing Diva which corrupts or affects the administration, security, fairness, integrity, or proper conduct of this Giveaway).

 

15. Privacy/Data Practices: Information provided by an Entrant with their Entry for this Giveaway is subject to Dashing Diva’s Privacy Policy.  By entering this Giveaway, each Entrant agrees that Dashing Diva has the right to contact the Entrant using the phone number or email address provided with the Entrant’s Entry in order to administer and fulfill this Giveaway.  Entrants also agree to receive promotional and/or informational emails and/or SMS text messages from Dashing Diva. Entrants can unsubscribe from either Dashing Diva’s email marketing list or SMS marketing list or both lists at any time, however, unsubscribing from either list prior to the termination of the Giveaway Period will result in the Entrant being disqualified from the Giveaway.

 

  1. Disputes: Entrant agrees that any and all disputes, claims, and causes of action arising out of, or connected with, this Giveaway or any Prize awarded shall be resolved individually, without resorting to any form of class action, and the venue for such litigation shall be the U.S. District Court for the State of New York. If for any reason the U.S. District Court for the State of New York will not or cannot hear such action or proceeding, the venue for such litigation shall be the courts of the State of New York.  Entrant irrevocably waives any objection, which Entrant may now or hereafter have to the bringing of any such action or proceeding in such respective jurisdictions, including to the laying of venue based on the grounds of forum non conveniens and any objection based on the grounds of lack of in persona jurisdiction. Alternatively, Entrants and/or Dashing Diva can elect to enter Arbitration in the State of New York rather than engage in litigation. All issues and questions concerning the construction, validity, interpretation, and enforceability of these Official Rules, Entrant’s rights and obligations, or the rights and obligations of Dashing Diva under the terms of the Official Rules, shall be governed by, and construed in accordance with, the laws of the State of New York of the United States of America, without giving effect to any choice of law or conflict of law rules (whether of the State of New York or any other jurisdiction), which would cause the application of the laws of any jurisdiction other than the State of New York. By participating in this Giveaway, an Entrant HEREBY KNOWINGLY, VOLUNTARILY, AND INTENTIONALLY WAIVES ANY RIGHT THAT MAY EXIST TO HAVE A TRIAL BY JURY IN ANY LITIGATION BASED UPON OR ARISING OUT OF, UNDER, OR IN ANY WAY CONNECTED WITH, THIS GIVEAWAY.
